Whataburger sued after alleged onion allergy reaction despite no-onion request

A Texas man, Demery Ardell Wilson, is suing Whataburger for negligence, alleging the chain served him onions despite his request to omit them, triggering an allergic reaction.

Filed in Harris County’s 269th Judicial District Court on April 25, the lawsuit accuses Whataburger of failing to uphold proper standards of care, resulting in personal injury.

“There was a manufacturing defect in the food at the time it left [Wilson’s] possession,” the petition reads, adding the meal was “unreasonably dangerous.”

Wilson says he required medical attention after consuming the meal on July 24, 2024. He is seeking between $250,000 and $1 million in damages.

Whataburger has not commented on the case.

The suit is Wilson’s second recent fast-food litigation; a previous complaint against Sonic Drive-In in 2024 was dismissed.

Wilson is represented by attorney Husein Hadi of the Hadi Law Firm, who has yet to respond to media inquiries.

The restaurant’s location was not disclosed in the filing.
