The Attorney General of the Federation, Lateef Fagbemi (SAN), has been accused of obstructing the arraignment of Oba Otudeko in a N12.3 billion fraud case.
According to sources, Fagbemi overruled the EFCC, opting for an out-of-court settlement and assuming control of the case.
“The AGF overruled the EFCC, preventing the agency from forcing Oba Otudeko to appear for arraignment,” a source told SaharaReporters.
The EFCC had cited Yahaya Bello’s case as precedent, insisting Otudeko must first enter a plea. Justice Chukwujekwu Aneke adjourned the matter to June 11, 2025, to allow for a potential settlement or arraignment.
Otudeko is facing a 13-count charge with others, including former First Bank MD Olabisi Onasanya. Defence and prosecution lawyers confirmed ongoing negotiations. Justice Aneke ruled that arraignment must precede hearing of preliminary objections.
Attempts to get comments from the AGF’s office were unsuccessful.
