Eligibility case: Judge grants Atiku order to serve Tinubu through APC
Justice Inyang Edem Ekwo of the Federal High Court in Abuja has granted a request by former Vice President and African Democratic Congress (ADC) presidential candidate, Atiku Abubakar, to serve court documents on President Bola Tinubu through his party, the All Progressives Congress (APC), according to a report by Daily Post.
Justice Ekwo granted the ex-parte application on Wednesday in a suit filed by Atiku and the ADC seeking to disqualify Tinubu from contesting the January 16, 2027 presidential election. Atiku’s lawyer, Omotayo Ojo, told the court service would be effected within seven days. The judge ordered this and adjourned the matter till September 28 for mention.
Also listed as defendants are the APC and INEC. Tinubu and APC have filed counter-affidavits denying submitting any forged certificate to INEC, insisting the NYSC has never denied issuing Tinubu a discharge certificate. Their lawyer, Akin Olujinmi, SAN, argued the plaintiffs produced no disclaiming evidence from NYSC and described the suit as incompetent. INEC separately challenged the suit’s competence on multiple grounds.
