Court permanently dismisses Reflecting Pool vandalism case against ex-Olympian David Hearn
A Washington judge has permanently dismissed the Lincoln Memorial Reflecting Pool vandalism case against former US Olympic canoeist David Hearn, preventing prosecutors from bringing the case again.
ABC News reported that Superior Court Judge Todd Edelman dismissed the case with prejudice Thursday after prosecutors previously acknowledged evidence indicated a government contractor caused the damage.
The Justice Department had sought dismissal without prejudice, which would have allowed prosecutors to revive the case within the six-year statute of limitations.
Edelman said allowing that possibility could expose Hearn to a meritless prosecution.
“Today’s dismissal with prejudice ensures that the DOJ cannot bring this case against him again. This decision is a victory for the rule of law and for an innocent American seeking justice,” Edelman said.
President Donald Trump had publicly criticised prosecutors’ earlier decision to drop the charge and maintained vandals damaged the pool lining.
The Justice Department did not immediately respond to ABC News’ request for comment Thursday.
