Appeal Court clears Fidelity Bank in ₦10m rights violation case

The Court of Appeal in Abuja has cleared Fidelity Bank Plc of liability in a fundamental rights case involving Michael Kundera, overturning an earlier Federal High Court judgment.

According to Peoples Gazette, a three-member panel led by Justice Adebukola Banjoko allowed the bank’s appeal, ruling that no credible evidence linked it to Kundera’s arrest, detention or rights violation.

Kundera had sued after his arrest and detention in May 2023, naming the EFCC, its officials and Fidelity Bank as respondents.

The Federal High Court had declared his detention unlawful and awarded ₦10 million for the violation and ₦2 million in costs.

Fidelity Bank argued its involvement was limited to submitting a petition to the EFCC and that Kundera was not its subject.
