AAC sues Tinubu, National Assembly over refusal to transfer power to Shettima

The African Action Congress (AAC) has filed suit FHC/ABJ/CS/2353/2026 at the Federal High Court in Abuja against President Bola Tinubu over his failure to transfer power to Vice-President Kashim Shettima during his extended Europe trip.

According to legal filings reported by Daily Post, AAC National Legal Adviser Inibehe Effiong submitted the originating summons naming President Tinubu, Attorney-General Lateef Fagbemi, Senate President Godswill Akpabio, House Speaker Abbas Tajudeen, and the National Assembly as defendants.

The lawsuit contends that President Tinubu’s failure to transmit a written declaration before departing on August 30 violates Section 145(1) of the 1999 Constitution. The party argues that the National Assembly’s failure to empower Shettima after 21 days is unconstitutional.

“The AAC also prayed the court to issue an order of perpetual injunction restraining President Tinubu and future Presidents from proceeding on vacation without complying with the provisions of Section 145(1) of the 1999 Constitution (as amended),” the suit reads in part. No hearing date has been set.
