Halle Berry loses primary custody of 13-year-old son to ex-husband Olivier Martinez

A court has awarded Olivier Martinez primary physical custody of his 13-year-old son, Maceo, with Halle Berry, ending the 50/50 arrangement the exes previously shared, the Daily Mail reports, citing TMZ.

Martinez, 60, now has the boy most of the time, while Berry, 60, has lost overnight visits. She keeps joint legal custody and holds the tiebreaking vote when the two disagree on decisions about their son.

The dispute escalated after Martinez accused Berry of physically abusing Maceo during a September 26 incident. Berry denies all the allegations.

Martinez did not win everything. The judge dissolved an earlier temporary restraining order and denied his request for a domestic violence restraining order.

Berry’s attorney, Marina Beck, welcomed that outcome. “We are extremely pleased that the Court has dissolved the TRO,” she said. Beck added that Berry remains focused on her family’s well-being.

Martinez’s lawyer, Patrick Baghdaserians, said Berry’s team asked the court to restore the equal arrangement and was refused. The judge also declined to reopen evidence over an Instagram post by Berry that Martinez’s lawyers said breached the temporary order.

In her own filings, Berry accused Martinez of interfering in decisions about Maceo’s schooling, healthcare and therapy. She asked for greater legal authority over those areas, saying the dispute had harmed her son’s wellbeing.

The judge is expected to revisit custody next month.

Berry and Martinez married in 2013, separated in 2015 and finalised their divorce in 2023.
