Judge rules Trump DOJ illegally fired former FBI director’s daughter, Maurene Comey
A federal judge has ruled that President Donald Trump’s administration illegally dismissed Maurene Comey, daughter of former FBI Director James Comey, from her position as a federal prosecutor in New York.
According to the Associated Press, Judge Jesse Furman delivered the ruling on Monday, October 26, declaring that Comey’s dismissal in July 2025 violated constitutional and statutory protections.
Comey, who served as an assistant US attorney for a decade, alleged that her dismissal was politically motivated because of her father’s longstanding conflict with Trump.
The judge rejected the Justice Department’s argument that the president possessed unlimited authority to dismiss federal prosecutors.
Furman ruled that the termination violated the constitutional separation of powers, the Administrative Procedure Act and Comey’s due process rights.
He ordered her retroactive reinstatement and back pay through December 20, although she has since entered private practice.
Comey’s lawyers welcomed the judgment, describing it as a victory for civil servants and constitutional accountability.
