Surrogate’s request for say in sick newborn’s care denied by Supreme Court

A surrogate who refused a California couple’s request for an abortion has asked the U.S. Supreme Court to intervene in a custody dispute over the newborn she carried, according to a report by CNN.

McKenna West, an Alaska resident who gave birth in Dallas in August, is seeking to block a California court ruling recognizing Nausheen Gilkar and Omar Ahmed as the child’s legal parents. The baby, born with a serious heart defect, has already undergone the first of three planned surgeries.

A Texas court granted full credit to the California judgment on September 2, dismissing West from custody proceedings. Justice Elena Kagan, who handles emergency matters from the relevant appeals circuit, has yet to rule on the request.
