US moves to review green card sponsorship requirements

Share:

The United States government is preparing to revise employment-based green card sponsorship requirements, introducing stricter recruitment and compliance standards for employers hiring foreign workers.

According to PUNCH, the proposed changes to the Permanent Labor Certification (PERM) programme have cleared review by the Office of Management and Budget.

The reforms, developed by the Department of Labor, aim to strengthen protections for American workers, particularly those affected by layoffs.

The proposed regulations could affect foreign professionals seeking permanent residency through employer sponsorship under the EB-2 and EB-3 visa categories.

Employers may face tougher recruitment requirements and additional obligations to demonstrate compliance with federal non-discrimination laws.

The proposal is expected to be published in the Federal Register, allowing stakeholders to submit comments during a public consultation period lasting approximately 30 to 60 days.

However, the specific provisions remain confidential pending publication.

The proposed changes will not take effect until the consultation process is completed and final regulations are issued.
