LIST: Nine types of marriages that may not qualify for UK spouse visas

Share:

The United Kingdom has outlined immigration requirements that could prevent certain marriages from qualifying for spouse visas or residence permits, affecting foreign nationals seeking to live with their partners in the country.

According to Vanguard, the UK Home Office assesses applications based on marriage validity, relationship authenticity, age requirements and compliance with immigration regulations.

The conditions are contained in the government’s Immigration Rules, particularly Appendix Relationship with Partner.

Although British authorities have not published an official list of nine prohibited marriage types, the following circumstances could result in visa refusal.

1. Sham marriages: Marriages entered into primarily to bypass immigration controls without genuine relationships may be rejected.

2. Legally unrecognised marriages: Marriages not legally valid in the countries where they were conducted may fail immigration requirements.

3. Underage marriages: Both partners must be at least 18 when applying.

4. Marriages between close relatives: Relationships involving prohibited degrees of kinship may be ineligible.

5. Polygamous marriages: Additional spouses may face restrictions, even where such marriages are legally recognised abroad.

6. Unresolved previous marriages: Applicants must generally demonstrate that earlier relationships have permanently ended.

7. Marriages without physical meetings: Couples who have never met in person may be refused visas.

8. Non-genuine relationships: Applicants must prove their marriages are genuine and continuing.

9. Marriages without appropriate immigration permission: Foreign nationals marrying in Britain must comply with applicable visa and registration requirements.

The Home Office considers individual circumstances and supporting evidence before deciding applications.

Applicants are therefore advised to verify their eligibility and ensure their marriages satisfy the relevant legal and immigration requirements before submitting applications.
